Notwithstanding the terms of Section 2(a) to the contrary, with respect to the Elastic Use Program, any Licensee site permitted under U.S. export laws to access such Elastic Use Program(s) shall have the right to access and use the Elastic Use Program(s) without regard to its proximity to the Designated Site.
